Indeed. I’m sure we all have similar stories. And sometimes the rights holder wants so much money it also leads to the item not being used. Many years ago I wanted to include a story by Gish Jen in an anthology I was putting together but her agent wanted $3000. My argument that inclusion would lead many new readers to her author who might otherwise never have heard of her got nowhere so I did the book without that piece!

But the issue that started this thread, I think, was how to find out who owns rights to photographs, and I think we’ve made some good progress!

Hi,

Commiserations, but as far as I know there’s no way to coerce a rights-holder.  When I arrived at the University of Newcastle 28 years ago (I’ve since retired), a colleague there had just had the horrible experience of Australian poet Gerald Murnane refusing permission for him to quote Murnane’s work—after my colleague had written a (very positive) full-length monograph on it.  This effectively killed the project.  

Disclaimer: I may have details wrong, but that’s how I remember the story.

One major collected edition of a twentieth-century author is lacking at least one volume because the owner of preprint material refuses to grant persmission to editors to use it or even to see it.

I am going to be using this image of LW and VW in my forthcoming book. The source is The LIFE Picture Collection. But, I am curious where it originally appeared. Time magazine? It looks to me like a much earlier photograph from the one that appeared on the cover of Time. 

Just wondering if anyone knows where it first appeared.
