[Prep Lab Students] FW: Law enforcement and immigration status

Hi Everyone,

Please review the message below from Dr. Turro, our Department Chair.

As with any other major lab event (fire, shower use, eyewash use, loss of consciousness, body fluid cleanup, utility failure, etc.) I should be notified immediately. The easiest way to do this is via the GroupMe. Linda, MJ, Sarah, and Emma know to call my cell phone if I am off campus when a major event occurs. I will handle any paperwork and sending information up the chain of command.

Best,
Tyler

Subject: FW: Law enforcement and immigration status

CBC community,

The university has issued the following advisories regarding potential visits to classrooms offices and clinics by law enforcement officers related to the immigration status of students and patients. I have been asked to share this with anyone who teaches in the department and with office staff who work with students.

Please see highlighted areas. It is important to note that university employees (which includes GTAs) cannot disclose a student’s immigration status to law enforcement because doing so would be a FERPA violation.

In addition to contacting OSUPD at 614-292-2121 and the office of legal affairs at 614-292-0611, also please contact me (turro.1) and/or one of the department’s Vice Chairs listed below if law enforcement comes to your classroom, lab, or office.

Dr. Jackman (undergraduate students, jackman.14)
Dr. Schultz (graduate students, Schultz.133)
Dr. Hadad (staff/research, hadad.1).

Thanks,

Claudia Turro

Classroom/Academic Spaces

The university has received questions about law enforcement and immigration status in our classroom settings and academic spaces.

As a reminder, the Family Educational Rights and Privacy Act (FERPA) protects the privacy of student education records, including immigration status, for all students. That means university employees cannot disclose a student’s immigration status to law enforcement – proactively or in response to questions – without consultation with the Office of Legal Affairs.
Generally, all local, state and federal law enforcement agencies – including U.S. Immigration and Customs Enforcement (ICE) – coordinate with the Ohio State University Police Division (OSUPD) when they have enforcement needs on campus. We anticipate that the process will continue to be followed, however, if law enforcement come to your classroom space or office, contact OSUPD at 614-292-2121 and the Office of Legal Affairs at (614) 292-0611 to assist.

The Ohio State University will follow all state and federal laws. The Office of Legal Affairs will provide guidance should any changes to the law impact our academic policies or practices.

Thank for your assistance in serving our students.

Clinical Spaces

The university has received questions about law enforcement and immigration status in our clinical settings. First, it is important to note that nothing has changed with our services, policies, or practices for the immigrant patient population.

All care providers, including students, must abide by the Health Insurance Portability and Accountability Act (HIPAA) and provide care per clinical expectation. HIPAA applies to all patients, regardless of immigration status. This means that care providers cannot disclose any information about a patient’s immigration status to law enforcement – proactively or in response to questions. Additionally, there is no requirement to document immigration status and, generally, patients are not asked about their status unless it directly relates to their health care.
