I know that, like myself, everyone religiously reads the Compliance Companion and takes the test at the end :), so this is probably an unnecessary e-mail! However, in this issue, I noted several items we might want to look at more closely and assess our practices:
1. Date of note. I have never looked at this to be truthful and assume that the resident note is from the day of service and my attestation is the date I do it. Not sure that is the case and when we get a load of these, maybe we don't check this box. I will check now!
2. False claims penalty increase. The increase in penalty enforcement and the apparent decision to not necessarily look away when we "goof" should be analyzed. I know that SDF is something we bill Medicaid for but Medicaid doesn't pay and if Medicaid pays, I doubt that they know what they are paying for. I am working to get OH Medicaid to recognize SDF as a covered service, but right now, we may want to reconsider billing based on the info in the Companion.
3. Timely outpatient notes. I don't know how we are dealing with part-timers who are here infrequently and who have outstanding charts. I note many in the Monday morning reconciliation.
4. In the past we have had some folks accessing their own child's record (without clearance ) or accessing children of friends with good intentions, but in violation of HIPAA. This is a serious no-no as you have seen in cases of celebrity hospitalization and hacking by employees.
For those of us who have moved into the electronic health record age, this stuff is a pain but mandated in many cases by law. I lectured to the dental student last week and none knew of the limitations and regulations around contacting patients by cellphone. It is hard to keep up but Kathleen and staff do most of the hard work and tell us what we need to do.
If you have an OH license, the test comes with a credit of CE, so that is an added benefit above and beyond that warm feeling you get from knowing you are compliant!
