[DSOSU] Accessible Performances: Scheduling, on Request or both?

While scheduling accessibility supports for specific performances (ASL, Audio Description, Captioning, ....) can be a way of welcoming the community, building an audience and being efficient with accessibility resources but it may not meet everyone’s needs or fulfill a venue’s obligation to accommodate.  This decision reinforces the need  have a clear process for patrons to request accommodations beyond scheduled performances and how venues need to  consider those requests to determine if they are reasonable.

The court said “Fox’s one-captioned-performance policy denies persons with hearing impairments an equal opportunity to gain the same benefit as persons without hearing impairments, and that deaf and hard-of-hearing individuals therefore do not have meaningful access to the benefits the Fox provides.”

 The eighth circuit upheld a district court decision supporting captioning  on request at the Fox Theater in St. Louis. While focused on captioning,  the decision’s logic holds true for ASL and Audio description.
