Copyright is very complicated.

What is copyright infringement?
As a general matter, copyright infringement occurs when a copyrighted work is reproduced, distributed, performed, publicly displayed, or made into a derivative work without the permission of the copyright owner.

Where is the public domain?
The public domain is not a place. A work of authorship is in the “public domain” if it is no longer under copyright protection or if it failed to meet the requirements for copyright protection. Works in the public domain may be used freely without the permission of the former copyright owner.

We are very, very fortunate that Leonard Woolf and Quentin Bell each endeavored to share such an amazing range of Virginia Woolf's private writings, beginning with A Writer's Diary and bringing those materials out of the archives and into the light.

Below is the citation and the link to a useful article (published in 1985) that can help clarify some of the issues surrounding copyright in the US (even though some changes have been made in the interval).

Two key quotations from the author, Peggy L. Fox:
"Upon occasion I have found it necessary to protest to a scholarly journal or scholarly author that material has been quoted without proper credit and copyright lines being given (let alone a fee being paid) and have met with resistance on the grounds of 'intellectual freedom"—i.e. the concept that since scholars are engaged in spreading knowledge, they should be allowed to quote whomever they wish at whatever length without acknowledgement or payment to anyone" (129).

and

"...any work published posthumously can secure copyright for 75 years from the date of publication, even if the author has already been dead for a considerable length of time. Thus the unpublished works (letters, notes, unpublished manuscripts) of deceased authors are not in the public domain" (131).

And...on a related but different thread...having had to intervene and asked contributors to remove quotations of lyrics from essays that were published in the Miscellany, however resonant with Woolf culture the lyrics might be, I should remind everyone that quoting lyrics without permission from the copyright holder is in a totally different domain of restrictions than "fair use" prose and that it is absolutely unacceptable to quote without formal permission (if you happen to read a book that includes lyrics, you should take a look at the front matter--unless the publisher likes to take on high risk adventures in copyright, you will see a reference to each and every quoted lyric). ​Having just returned from a research trip to the Berg a few weeks ago, I thought I'd chime in. I was able to take hundreds of scans of microfilm pages of Woolf's diaries, with the understanding that they would be for my own use in my book

I was able to take hundreds of scans of microfilm pages of Woolf's diaries, with the understanding that they would be for my own use in my book project, and that under no circumstances would I upload them or share them on any kind of public platform.  Those are the Berg's rules, at least for the diaries.  Can't vouch for the manuscripts of other works that are in the public domain.

So much of the archive remains behind closed doors for those without access to the microfilms or CD, and even those are becoming less and less accessible. Perhaps what’s needed is a big corporate (so to speak) digital project along the lines

Perhaps what’s needed is a big corporate (so to speak) digital project along the lines of the Beckett Digital Archive, with the Estate and the archives’ involvement? The Estate and the Berg have been nothing but amenable to my own smaller digital edition. There’s certainly an intellectual case to be made for a large-scale project like that – not that I’d have a clue how to get it off the ground.

Your discussion of copyright and permission to use images in your scholarly work inspired me to write. I’ve long hoped to see a Virginia Woolf Archive similar to the Walt Whitman Archive (U Nebraska & Iowa), Willa Cather Archive (U Nebraska), or George Eliot Archive (formerly U Nebraska, now Auburn U), where researchers from all over the world can find and freely download the author's published and unpublished writings, images—including portraits of the author and illustrations of her scenes and characters, and hundreds of contemporary reviews. Increasingly, these sites are also providing the advanced search options and data visualization tools to help drill down into the thousands of texts collected.



Of course, it’s much easier for Victorian and Modern authors who published prior to 1928 (rule-of-thumb in US: copyright on published works lasts 95 years), or who died before 1953 (unpublished works are protected for 70 years after the death of the creator). Those texts and images are now in the public domain and require no permission to republish.



You could make a great start with Virginia Woolf because 6 of her 9 published novels are already in the public domain, and if I'm interpreting US copyright law correctly, all the writing she left unpublished at the time of her death (1941), is also available to be published in manuscript images (with transcriptions and editorial apparatus).



I bet the knowledgeable people on this list could create a wonderful digital archive of Virginia Woolf materials. (If there’s already one, I’m sorry not to know of its existence.) You probably have already collected hundreds of manuscript photos, images, and pdf documents to share. One of you could start by opening a shared Box or Dropbox folder for everyone to contribute your digital materials. I learned by working with the creators of the Cather and Whitman sites and then with students to build the George Eliot Archive and I'd be happy to offer advice and answer questions if you'd like to create a simple website, something like the George Eliot Archive. According to a friend who is a professional picture researcher, for example, whole archives have been bought by wealthy people needing somewhere to park their money, and these typically are impervious to any negotiation. Then again, Peter’s advice is something I’ve followed many times and often successfully when dealing with a human who understands the situation.

Maybe a kind of index to Bloomsbury-related images (an update of Elizabeth Richardson’s invaluable book) would be possible as a crowd-sourced online space? (Says he who has no idea how that might be realized!)

I am going to be using this image of LW and VW in my forthcoming book. The source is The LIFE Picture Collection. But, I am curious where it originally appeared. Time magazine? It looks to me like a much earlier photograph from the one that appeared on the cover of Time.



Just wondering if anyone knows where it first appeared.
